How to sign up for a Formal Review for your Polk County DUI arrest

You only have 10 days to request a “Formal Review” to challenge the administrative suspension of your driver’s license for blowing over 0.08 on the breath test machine or refusing the breath test.  Unfortunately, many people do not realize this 10 day deadline and fail to request a Formal Review to fight the 6 to 18 month suspension of their driver’s license by the Department of Highway Safety and Motor Vehicles (DHSMV).  The DUI citation the officer gave you is your driver’s license for 10 days so that you can drive to Tampa and sign up for the Formal.  This 10 day notice is printed on your DUI citation the officer gave you.
I had a client that spoke to an attorney who advertises for Polk County DUI’s, but does not have an office in Polk county, that told the driver to “call the DHSMV on the phone and request a Formal Review”.   This incorrect advice was given within the 10 days, but by the time he called me, it was past the 10 days. That is just one of many reasons why you need a local attorney that knows the rules, practices, and procedures of Polk County because it can cost you severely.  Luckily, I explained this to the DHSMV and they gave him a “temporary permit” for “business purposes’ so he could continue to drive until a decision was made on his administrative suspension.
In order to request a “Formal Review” for a Polk DUI arrest you must go to the DHSMV in Tampa.  The Tampa office handles the administrative DUI hearings for Polk County.  The address is 2814 E. Hillsborough Ave., Tampa, FL 33610.  It is the building in the front, next to the post office.  You will see this sign at the entrance:
There is a $25.00 fee for having a review.  YOU MUST ALSO PROVIDE A LEGIBLE COPY OF YOUR DUI TICKET (citation).  The DHSMV needs to be able to read your driver’s license number so that they can determine whether you are entitled to a “temporary permit”.  You must also fill out the following form:

These hearings to get your license back play a key role in the defense of your case.  If you win and your license is reinstated, your full driving privileges will be restored.  That allows you to take your time and fully investigate and litigate your DUI case in court.  You will be able to get copies of the police reports from the DHSMV.  You may also subpoena witnesses including the officer who arrested you, the breath test operator, witnesses, and the Agency Inspector who is supposed to insure that the breath test machine is in proper working order.  This allows an experienced DUI attorney to start preparing your case for court developing defenses and locking in the testimony of the officers trying to convict you of DUI.
